Newspapers, radio, TV and the Internet are filled with advertisements that offer for a fee to erase accurate negative information in your credit file. The credit repair scam artists who run these ads can’t deliver. Only time, a deliberate effort, and a plan to repay your bills will improve your credit history record. This section is designed to help you understand credit reports and credit repair scams.

Credit Reports

Does your credit report accurately represent you? A recent study conducted by the Public Interest Research Group (PIRG) found over 70% of credit reports contain errors. Among the principal findings of the report were the following:

* Twenty-nine percent (29%) of the credit reports contained serious errors that could result in the denial of credit.”
* “Serious” errors included false delinquencies, public records or judgments that belonged to a stranger, or credit accounts that did not belong to the consumer; Seventy percent (70%) of the credit reports contained mistakes or errors of some kind, also including the following:

* Forty-one percent (41%) of the credit reports contained incorrect personal demographic identifying information; Twenty percent (20%) of the credit reports were missing major credit cards, loans, mortgages, or other accounts that are critical to demonstrating consumer credit worthiness.

One of the first steps to credit repair, is understanding credit reports. When applying for mortgages, home loans and refinances, one of the most important factors in determining whether or not you will be approved is your credit. This is true for other important factors as well, such as obtaining lower interest rate auto loans and credit cards. Good credit can open many doors.

If you have had credit issues in the past, or are currently in a situation that will affect your credit, be prepared to address these issues upfront.

The mortgage industry has its own language when it comes to your credit report. Mortgage lenders get their name from the grading system they use. Items that determine your credit rating (A+ to D-) are payment history, amount of debt payments, bankruptcies, equity positions, and credit scores. Credit scores are also known as “FICO” scores, and are used by the mortgage industry to determine credit risk. The higher the credit score, the better the credit risks.

FICO stands for Fair Isaac Company, the company that created the original scoring system. Each credit bureau has its own unique system that allows them to offer a score based solely on the contents of the credit bureau’s data about an individual. A numerical score at one bureau is the equivalent of the same numerical score of another. For example, a score of 700 from Experian indicates the same creditworthiness as a score of 700 from Trans Union or Equifax. However, the calculations used to determine these scores are different for each bureau.

FICO scores range from 375 to 900 points. A score of 650 or above indicates a very good credit history. However, lenders do not necessarily give the same value to a particular credit score, and they do not necessarily use credit scoring!

FICO scoring places a value on the types of accounts you hold, as well as your credit history. The formula that determines your scores, however, is not disclosed to the consumer.

The 5 most important factors to determining your credit score are:

* Your payment history
* The amount of outstanding debt you have compared to your credit limit
* Your credit history
* The types of credit you use
* Negative information

Remember, FICO scores range from 375 to 900 points. A score of 650 or above indicates a very good credit history.

You’ve seen it in newspapers, maybe even heard it on the radio or television — Erase accurate negative information in your credit file! — The credit repair scam artists who run these ads can’t deliver. This section is designed to help you understand the two top credit repair scams that are circulating newspapers, television, magazines and radio.

Credit Repair Scam #1 – File Segregation

If you filed bankruptcy, you may be the target of a credit repair scam called “file segregation.” In this scam, you are promised a chance to hide unfavorable credit information by establishing a new credit identity. That may sound like a good idea but, file segregation is illegal. If you use it, you could face fines or even a prison sentence.

Credit Repair Scam #2 – New Credit Identity

If you have filed for bankruptcy, you may receive a letter from a credit repair company warning you about the inability to obtain credit cards, personal loans, or any other types of credit for 10 years. For a fee, the company promises to help you hide your bankruptcy and establish a new credit identity to use when you apply for credit. These companies also make pitches in classified ads, radio, TV, and the Internet.

When signing up for the service you will be required to pay a fee and may be directed to apply for an Employer Identification Number, commonly referred to as an EIN, from the Internal Revenue Service (IRS). Typically, an EIN is quite similar to a social security number and is used by businesses to report financial information to the IRS and the Social Security Administration.

After you receive your EIN, the credit repair service will tell you to use it in place of your social security number when you apply for credit, inform you to use a new mailing address and obtain additional credit references.

That may sound like a good idea but, using false information is illegal and considered fraud. If you use it, you could face fines or even jail time.

Credit Repair Company’s And False Claims

Credit Repair False Claim #1: You will not be able to get credit for 10 years.

Each creditor has its own criteria for granting credit. While one may reject your application because of bankruptcy, another may grant you credit. And, given a new reliable payment record, your chances of establishing additional credit could probably increase as time passes.

Credit Repair False Claim #2: The company or “file segregation” program is affiliated with the federal government.

The federal government does not support or work with companies that offer such programs.

Credit Repair False Claim #3: The “file segregation” program is legal.

It is a federal crime to make any false statements on a loan or credit application. It is a federal crime to misrepresent your Social Security number. It also is a federal crime to obtain an EIN from the IRS under false pretenses. Further more, you could be charged with mail or wire fraud if you use the mail or the telephone to apply for credit and provide false information. Worse yet, file segregation likely would constitute civil fraud under many state laws.

Your Rights Under The Credit Repair Organizations Act

This law prohibits false claims about credit repair and makes it illegal for these companies to charge you until they have performed their services. It requires that companies tell you about your legal rights. Credit repair companies must provide this in a written contract that also spells out just what services are to be performed, how long it will take to achieve results, the total cost, and any guarantees that are offered. Under the law, these contracts also must explain that consumers have three days to cancel at no charge.

“Bad Credit Repair” is one of the top searched keywords online when it comes to consumers searching for solutions to bad credit. Unfortunately, many consumers with bad credit are also searching for “bad credit loans”, “bad credit lenders” and similar terms. The reason I say its unfortunate is that most of these people don’t realize that the worst thing they can do for their financial situation is a get a loan with bad credit.

If they succeed in finding what they’re looking for, they are going to pay extremely high interest rates and that is not the intelligent way to go about repairing your financial situation. It’s certainly a good idea to want to get new positive accounts reporting on your credit reports, but it’s definitely not a good idea to pay such high interest rates. It can make it even harder for a person to meet their financial obligations and lead to even worse credit.

If you have bad credit, you should first see what you can do to get negative items removed from your reports. After you have done everything to get the negatives removed, then it is wise to start rebuilding your credit. Is Credit Repair A Scam?

If you want to find an industry with a horrible reputation look no further than credit repair. Over the years I have seen countless companies coming to my office wanting me to send all of my applicants for a mortgage who had bad credit to them. Most of them stated the same thing, “I will get it removed.” Let’s face it, if you owe the debt, it will not be removed. Most of the creditors sell debts owed to collections companies. These collections companies will not go away until you settle on the debt or pay it in full. The 3 credit bureaus do have to respond to a dispute within 30 days which must be verified. If the dispute is not verified, it must be removed. Credit Repair companies will dispute derogatory information on your credit report for you, but you can do the same thing yourself for free. You can also dispute items from your credit report on-line now.

The advantage of using a reputable credit restoration company is they dedicate all their time during your normal working ours to dispute inaccuracies on your report. Most working people don’t have time to do this. So you are paying someone else to do this since you don’t have the time to do it yourself. So is Credit Repair a scam? Well not exactly. They are a legitimate business as long as they give you the correct information. Can they get information removed you owe? They can if the bureaus don’t respond in time, and believe me the bureaus are set up to respond quickly. There systems are automated now. They can blast through a dispute letter in a few key strokes. The Bureaus will also disregard repetitive disputes as “frivolous.” Credit restoration companies claim that if the following inaccuracies are on your credit report, it has to be removed.

Credit Bureaus reporting: $190.02

Should be reporting: $190.20

The FTC claims that this is false.

So the big question is Credit Repair a SCAM? Well there are a lot of credit repair companies out there that just take your money, and hope you go a way. So make sure you get references when using a credit restoration company. There are reputable companies out there, and there are companies that just take your money. It is important you know what is on your credit report, and take the time to learn how to fix errors on your report, or pay a company to provdie the service for you.

Credit Repair Essential Guidelines

Chapter 7 Bankruptcy

A discharged Chapter 7 bankruptcy will show in the Public Records section of your credit report for 10 years from the initial filing date – please note that the filing date is different from, and prior to, your discharge date.

Debts that are discharged in a bankruptcy can continue to report for seven years. It is important to note that once a debt is discharged it should not report with a past due balance, or in a charge off or collection status.

Dismissed Chapter 7 bankruptcies will report for ten years. A dismissed bankruptcy is a bankruptcy which was filed and thereafter cancelled or disallowed.

Chapter 13 Bankruptcy

A Chapter 13 bankruptcy which has been completed will continue to report for seven years from the initial filing date, rather than the discharge date.

A Chapter 13 bankruptcy which was not completed will continue to report for seven years from the initial filing date.

Bankruptcy and the Fair Credit Reporting Act – A Legal Note

It may be of interest to note that the only reference to bankruptcy in the Fair Credit Reporting Act is a blanket rule that limits the reporting time to 10 years following the filing date. See § 605. [15 U.S.C. §1681c] (a). The credit bureaus, however, voluntarily make exceptions for Chapter 13 bankruptcies as noted above.

Collections – Overview

Collections are unique for the reason that they typically change hands, often several times during their lifetime. Important credit repair tip! Please note that only one collector at a time can legally report the debt; and only the collector that owns the debt can legally report it. All duplicate collection accounts for the same debt should be deleted from your credit report.

Collections can report for seven years from the original default date. The original default date is defined as the first time that you missed a scheduled payment. The original default date cannot be reset, and the reporting period cannot be extended by subsequent collectors.

Collections of Charged Off Accounts

Collections of charged off accounts have a slightly different reporting period than other collections. Charged off accounts can continue to show on your credit report for seven years plus 180 days from the date of original default, as defined above. This means that this extended reporting period does not start with the charge off date, but rather with the earlier default date.

Once a creditor has passed a charged off account to a collector, the original creditor cannot report the charged off amount as a past due balance. The balance should report as zero; the charged off amount may report on a separate line.

Unpaid Judgments

Unpaid judgments can continue to report for seven years or until the governing state statute of limitation has expired. You need to check your state statute of limitations to know for sure. State statute of limitations for judgments range from 4 years (PA) to 21 years (OH), and in some cases may be renewed one or more times.

Paid Judgments

Paid judgments can report for seven years from the initial filing date. This is handy to know if you are in a credit repair program; you may quickly remove a judgment from your report if you are willing to pay it, as long as the original filing date is seven years old. For legal support see FTC Official Staff Commentary § 605(a)(2): “Paid judgments cannot be reported for more than seven years after the judgment was entered, because payment of the judgment eliminates any “governing statute of limitations” under this subsection that might otherwise lengthen the period.”

Tax Liens

Paid tax liens may not report more than seven years beyond the date of payment. Unpaid tax liens may report as long as they are in effect. If you are in doubt consult a CPA or tax attorney.

Student Loans

Late payments on your student loans will cease reporting after seven years. Defaulted student loans are another story…

A 1991 amendment to the Higher U.S. Department of Education Act lifted all time limits for collection of student loans. The reporting of defaulted student loans on your credit report can now go on forever. In addition, a 1998 change in federal law made it virtually impossible to discharge a student loan in bankruptcy.

If you are in default on a student loan you are well advised to address the issue, sooner rather than later. Fortunately, there are excellent rehabilitation and consolidation programs now available to everyone. Credit repair is on everyone’s mind these days. And credit scores are for sale everywhere. There is only one problem. None of these advertised credit scores are the same as the credit scores that lenders use when making credit decisions. Whoa. That’s right. People spend huge amounts of money to buy credit scores which they mistakenly believe are relevant to their life. What the heck is the story? You want to know? Okay. I’ll tell you!

Lenders Use FICO Scores

Lenders use a type of credit score called the FICO score. FICO stands for Fair Isaac Corporation, the creator of this important score. The credit bureaus gather consumer credit data and run their data through the FICO credit score software to produce the scores that lenders use to make decisions.

Avoid Knockoff Scores

If you are starting a credit repair project or plan to get a loan in the near future and want to know where you stand you should purchase your FICO scores. But if you buy your scores from one of the credit bureaus websites you will get the bureaus own proprietary scores. And you will be no wiser than you were before because these knockoff scores can easily be 100 points different from your FICO scores; deceptive for your loan information, and useless for benchmarking your credit repair.

Major Credit Repair Weight

Fair Isaac is happy to tell you that the major part of your credit score is based on two categories. These are your payment history, weighing in at a hefty 35% of your score, and your account balances, tipping the scale at 30% of your total score. This is a bare bones fact, and much useful credit repair info is left unsaid, so I guess I’ll say it. If you care about your credit scores you need to focus on your revolving balances.

Revolving Account Bombs

Revolving balances are the lynchpin of your credit scores, and hence your credit repair effort. You can have a decade of perfect credit under your belt. You may have paid off a dozen cars and made every payment on time, but if you run up your credit card balances to the max and then check your credit scores you are in for a rude awakening. Maxed out credit cards will devastate your scores. Do you want some numbers? Okay. A maxed out card can erase 100 points from your score. An over-limit card can knock 150 points off; it’s a credit repair disaster. But wait, there is more.

Credit Repair Leverage

I don’t want you to feel like this is all bad news. Revolving debt is conversely the most powerful credit repair tool you have at your disposal for pumping up your scores. FICO recognizes 5 different balance tiers: 20, 40, 60, 80, and 100 percent usage. If you are getting a loan in the near future and have the resources to pay your balances under 20% of the limit your scores will be shining.

The Rest of the Story

The other ingredients relevant to your credit repair task include the age of your accounts, coming in at 15% of your score, new credit and inquiries at 10%, and the type, or mix of credit at the final 10%. These remaining ingredients are minor and for most people will take care of themselves as life goes on. I should, however, add that it is valuable credit repair advice to avoid opening new accounts before applying for a major loan, and to keep those inquiries to a minimum. Cheers!

There are some steps you can take to help repair your credit and gain a better chance at receiving these rates. Here are tips on how to do this.

One of the first things you need to do is to set out a plan to rebuild your credit, as well as how you will use your borrowing abilities in the future.
